How we handle your information, our commitment to accessibility, and the terms governing use of analyticalnutrition.com.
Analytical Nutrition (“we,” “us”) is a private clinical nutrition practice operated as a sole proprietorship by Nicole Visnic, CNS. This policy explains what information we collect through analyticalnutrition.com, how it is used, and the choices you have. It applies to this website. Information you provide once you become a client is additionally governed by the privacy practices of our clinical record system and the consent documents you sign at intake.
Information you give us. When you submit a consultation application, contact form, or newsletter signup, we collect what you enter — typically your name, email address, phone number, and the details you choose to share about your health concerns, symptom history, prior testing, and treatments you have tried.
Information collected automatically. Like most websites, we automatically receive limited technical information when you visit: IP address, browser and device type, pages viewed, time spent, and the referring website. This is used in aggregate to understand how the site is used.
Information from scheduling and payment. If you book a consultation or become a client, information is collected through our scheduling and practice management systems. Payment card details are handled directly by our payment processor; we do not store full card numbers.
Some information you submit — symptoms, diagnoses, medications, test results — is health information, and we treat it with corresponding care.
We use the information collected to respond to your inquiry and evaluate whether the practice is a good fit for your needs; to schedule and deliver consultations and clinical services; to communicate with you about your care, appointments, and protocols; to send educational content or updates where you have asked to receive them; to process payments; to improve the website and our services; and to meet legal, professional, and record-keeping obligations.
We do not sell your personal information. We do not rent or trade your contact details to third parties.
Information is shared only in limited circumstances: with service providers who operate our systems on our behalf (scheduling, practice management, email delivery, website hosting, analytics) and who are permitted to use it only to provide those services; with laboratories you have consented to use for functional testing; where you have given us direction or written authorization to share it, such as with your physician; and where required by law, regulation, legal process, or to protect the safety of any person.
This website relies on third-party tools, each with its own privacy practices. These currently include our website hosting and page platform, our email marketing and form software, our scheduling and practice management platform, our payment processor, and web analytics. When you interact with an embedded form or booking tool, the information you submit is transmitted to and stored by that provider under their terms. We encourage you to review the privacy policies of any service you use.
The website may also link to external sites, including social media profiles and podcast platforms. We are not responsible for the privacy practices or content of sites we do not operate.
We use cookies and similar technologies to keep the site functioning, remember your preferences, and understand aggregate usage patterns. Most browsers let you refuse or delete cookies through their settings; some site features may not work correctly if you do. If we use analytics or advertising pixels, they may collect usage information subject to the provider’s own policies. Where required, we present a cookie notice allowing you to limit non-essential cookies.
We keep information only as long as needed for the purposes described here or as required by law and professional record-keeping standards. Clinical records are retained for the period required for health records in California. Inquiry and marketing information is kept until you ask us to remove it or it is no longer useful.
We use reasonable administrative and technical safeguards to protect the information in our care, and we work with established platforms that maintain their own security programs. No method of transmission or storage over the internet is completely secure, however, and we cannot guarantee absolute security.
You may ask us what personal information we hold about you, request that we correct inaccurate information, request deletion of information (subject to records we are legally required to retain), and unsubscribe from marketing emails at any time using the link in any message or by contacting us directly. Unsubscribing from marketing does not stop communications necessary to your care.
California residents have additional rights under California privacy law, including the right to know what personal information is collected and how it is used, the right to request deletion, and the right not to be discriminated against for exercising those rights. We do not sell personal information as that term is defined under California law. To make a request, email Nicole@analyticalnutrition.com. We may need to verify your identity before responding.
This website is intended for adults. We do not knowingly collect personal information from anyone under 18 through this site. If you believe a minor has provided us information, please contact us and we will delete it.
We may update this policy as our practice, tools, or legal obligations change. The revision date at the top of this page reflects the most recent update, and continued use of the website after changes are posted constitutes acceptance of the updated policy. Questions about this policy can be directed to Nicole@analyticalnutrition.com.
This website, analyticalnutrition.com, is owned and operated by Nicole Visnic, a sole proprietor doing business as Analytical Nutrition (“Analytical Nutrition,” “we,” “us”). Nicole Visnic is a Certified Nutrition Specialist (CNS®) providing private clinical nutrition services with a focus on gastrointestinal and microbiome health.
These terms govern your use of this website and the educational content on it. Services provided to clients are additionally governed by the client agreement and consent documents signed at intake, which take precedence over these terms where they differ. By accessing or using this website, you agree to be bound by these terms. This website and our services are intended for individuals who are at least 18 years old.
Analytical Nutrition is committed to making its services accessible to everyone, including people with disabilities. We work to keep this website usable regardless of ability or assistive technology, and we welcome reports of accessibility barriers so we can address them.
Modification of services. We may modify or temporarily suspend the website at any time to perform maintenance, correct errors, or make improvements, including improvements to accessibility.
Reporting an issue. If you encounter an accessibility problem on this site, please contact us at Nicole@analyticalnutrition.com and describe the issue. We will make reasonable efforts to resolve it and to provide the information you were seeking in an alternative format.
Limitation. While we strive to meet accepted accessibility guidelines, we cannot guarantee compliance in every area of the site, and we are not responsible for accessibility barriers arising from third-party content or platforms outside our direct control.
The content on this website — including articles, podcast episodes, condition descriptions, and any educational material — is provided for general informational purposes only. It is not medical advice, diagnosis, or treatment, and it does not create a practitioner-client relationship.
Client outcomes, testimonials, and case stories shared on this website reflect the experiences of specific individuals. They are not promises, guarantees, or predictions of what any other person will experience. Results depend on many factors, including the nature and duration of your condition, adherence to recommendations, other medical care you receive, and factors outside anyone’s control. No outcome is guaranteed.
Nicole Visnic is a Certified Nutrition Specialist, not a physician. Services consist of nutrition assessment, education, and individualized nutrition protocols. We do not diagnose or treat disease, prescribe medication, or provide medical care.
Functional laboratory testing may be recommended as part of a program. Such testing is used to inform nutritional recommendations and is not a substitute for diagnostic testing ordered by your physician. Testing is billed separately by the laboratory. We may recommend that you consult your physician, and we may decline to work with you if we believe your needs require medical care we cannot appropriately provide.
Applications. Submitting an application or inquiry does not create a client relationship or guarantee acceptance into the practice. We maintain a limited caseload and accept clients based on fit.
Fees. Program fees are quoted before you enroll and are set out in your client agreement. Payment is due according to the schedule in that agreement. We do not accept insurance; the practice is private-pay. On request we can provide documentation you may submit to an HSA/FSA administrator or insurer, but we cannot guarantee reimbursement.
Supplements and testing. Supplements and laboratory testing are not included in program fees unless expressly stated. Supplements are purchased separately, typically through a professional dispensary; laboratories bill for testing directly.
Scheduling and cancellations. Appointment scheduling, rescheduling, cancellation, and missed-appointment terms are set out in your client agreement and communicated at booking.
Refunds and termination of services. Refund terms are governed by your client agreement. Either party may end the working relationship; we may discontinue services where continuing would be clinically inappropriate, where recommendations are not being followed in a way that makes progress unsafe or unproductive, or where fees remain unpaid.
To use this website and our services, you agree to provide accurate and complete information about your health history, medications, supplements, and other care you are receiving, and to update us when that information changes; to use the website lawfully and not to interfere with its operation, attempt unauthorized access, or introduce harmful code; to keep any account credentials for our scheduling or client portals secure and to notify us promptly of unauthorized use; and to make your own decisions about your health in consultation with your medical providers.
Withholding relevant health information can make recommendations unsafe. You are responsible for the accuracy of what you tell us.
All content on this website — text, protocols, educational materials, graphics, logos, photographs, and the Analytical Nutrition name and marks — is owned by Nicole Visnic or her licensors and is protected by copyright and trademark law. Nothing in these terms transfers any intellectual property to you.
You may view, download, and print content for your own personal, non-commercial use. You may not reproduce, republish, distribute, sell, or create derivative works from our content, or use our name or marks, without our written permission. Materials provided to you as a client are for your individual use and may not be shared or distributed.
If you submit a testimonial, review, comment, or other material to us, you confirm that it is truthful and your own, and that it does not infringe anyone’s rights. You grant us permission to use and publish it in connection with the practice, and you may withdraw a published testimonial at any time by contacting us. We may decline to publish, or may remove, any submitted material at our discretion.
This website links to third-party sites and uses third-party platforms for scheduling, forms, payments, and podcast hosting. We do not control those sites and platforms and are not responsible for their content, practices, or availability. A link is not an endorsement. Your use of a third-party service is governed by that provider’s own terms and privacy policy.
This website is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or current. You use the website at your own discretion and risk.
This disclaimer applies to website content. It does not limit the professional standard of care applicable to clinical services provided to clients.
To the fullest extent permitted by law, Nicole Visnic, her contractors, and her licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising out of or relating to your use of this website or its content, whether based in contract, negligence, or any other theory. Our total liability relating to the website will not exceed one hundred dollars ($100), or, for claims relating to services you purchased, the fees you paid us in the twelve (12) months preceding the claim. We are not liable for failures or delays caused by circumstances beyond our reasonable control. Nothing here excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless Nicole Visnic, her contractors, and her licensors from any claims, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the website or your breach of these terms.
We may modify these terms at any time by posting a revised version on this page. The revision date at the top reflects the most recent update, and your continued use of the website after changes are posted constitutes acceptance. We recommend reviewing this page periodically.
Governing law and venue. These terms and any use of this website are governed by the laws of the State of California, excluding its conflict of law provisions. The proper venue for any dispute is the state and federal courts located in Los Angeles County, California.
Dispute resolution. Except for claims for injunctive or equitable relief and claims regarding intellectual property rights, which may be brought in any competent court, any dispute arising under these terms will be settled by arbitration in accordance with the rules of the Judicial Arbitration and Mediation Service (“JAMS”). Arbitration will take place in Los Angeles County, California, in English, and the arbitral decision may be enforced in any court. The prevailing party in any action to enforce these terms is entitled to costs and reasonable attorneys’ fees.
Severability and waiver. If any part of these terms is held invalid or unenforceable, that part will be interpreted to reflect its original intent as closely as permitted, and the remaining provisions remain in full force. A waiver of any term in one instance is not a waiver of that term or any other term thereafter.
Entire agreement and assignment. These terms, together with our privacy policy and any client agreement you have signed, constitute the entire agreement between you and Nicole Visnic regarding this website. You may not assign your rights without our consent; we may assign ours in connection with a transfer of the practice. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and indemnification — will survive.
